1. Who we are
Baraza is operated by FIREBIRD COMPUTING LTD (“Baraza”, “we”, “us”), a company registered in Kenya. Contact: firebirdcomputing@gmail.com.
2. Eligibility & accounts
- You must be eligible to register as a voter in Kenya (18 or older) to hold an account.
- You must give accurate information and keep your login details secure.
- You are responsible for everything done through your account.
3. Acceptable use
You agree not to use Baraza to:
- post hate speech, ethnic incitement, harassment, threats or content that endangers others;
- spread deliberate misinformation about the electoral process;
- impersonate any person, candidate or institution;
- send spam, or send SMS to people who have not consented to hear from you;
- break any law, or infringe anyone’s rights.
We may remove content and suspend accounts that breach these rules. Content is screened and moderated, but you remain responsible for what you post.
4. Your content
You keep ownership of the content you create. By posting it, you grant Baraza a licence to host, display and distribute it on the platform so the service can work. You confirm you have the right to post it and that it does not break these terms.
5. Candidates & verification
Verification confirms that a candidate has submitted IEBC documentation — it is not an endorsement, and Baraza is independent of the IEBC, any party and any campaign. Candidates are responsible for the accuracy of the information they publish.
6. Paid features & payments
- Paid features include candidate verification, campaign plans, digital billboards and SMS credits. Prices are shown on the platform before you pay.
- Payments are made by M-Pesa paybill or bank transfer to FIREBIRD COMPUTING LTD and are confirmed by hand against our bank statement, usually within one working day. A paid feature goes live on confirmation, not on payment.
- SMS credits are consumed as messages are sent; credits for messages that fail to deliver are automatically returned to your balance.
- Except where the law requires otherwise, payments for delivered services are non-refundable. Purchased SMS credits do not expire; monthly plan bundles expire with the billing month.
- You are responsible for any taxes that apply to your use of paid features.
7. SMS campaigns
If you send SMS through Baraza, you are responsible for having the recipients’ consent and for complying with the rules of the mobile networks and the Communications Authority of Kenya, including honouring opt-out requests.
8. Independence
Baraza is a neutral civic platform. We are not affiliated with the IEBC, any political party or any campaign, and nothing on the platform is an endorsement of any candidate.
9. Service “as is”
We work hard to keep Baraza available and accurate, but we provide it “as is” without warranties. We do not guarantee uninterrupted service or that all content is accurate.
10. Limitation of liability
To the extent permitted by law, Baraza is not liable for indirect or consequential losses, or for content posted by users. Nothing in these terms limits liability that cannot be limited under Kenyan law.
11. Suspension & termination
You may stop using Baraza and delete your account at any time. We may suspend or close an account that breaches these terms or the law.
12. Governing law
These terms are governed by the laws of Kenya, and disputes are subject to the jurisdiction of the Kenyan courts.
13. Changes
We may update these terms from time to time. We will post the new version here and update the date above; your continued use means you accept the changes.
